February 2013 Update: CCSA v. LAUSD (Prop. 39 Litigation)
CCSA filed a Petition for Review in the California Supreme Court to challenge the Court of Appeals' decision that upheld LAUSD's use of "norming ratios" when determining classrooms offers for charter schools.

Update: CCSA v. LAUSD (Prop. 39 Litigation)
On December 7, 2012, the California Court of Appeal issued a brief decision in CCSA's Prop. 39 litigation against the Los Angeles Unified School District (LAUSD). In an unpublished opinion, the court upheld LAUSD's use of "norming ratios" when assigning classrooms to charter schools, finding that the practice is "consistent with the intent of Proposition 39." This court decision is limited and only applies to the unique facts of LAUSD.

Reminder: Don't Forget to Respond To Prop. 39 ADA Projections!
Under the Prop. 39 regulations, a charter school must respond to the district's concerns by either reaffirming or modifying its previous projections as necessary to respond to those concerns. If you fail to respond to the district by January 2, 2013, then the district's ADA projections provided in its December 1 letter are no longer subject to challenge.

Supt. Deasy Tells District Staff To Stop Hostility Around Proposed Co-Locations
CCSA has been made aware of some recent instances of hostility by District staff and students towards charter schools which have been offered co-locations at LAUSD facilities. Supt. Deasy wrote a letter this week telling staff to stop this behavior.

Have you received your final Prop. 39 offer?
On April 1, districts were required to provide charter schools who requested district facilities under Proposition 39, final notifications. If you have not received a final notification, CCSA recommends that you follow up with a letter requesting a final offer immediately.

Proposition 39: Working with SDUSD
San Diego Unified approved three offers at their meeting on Tuesday. All three of these schools already occupy district space but share it with a district school, so they have to go through the Prop. 39 process each year.

How Does Your Prop 39 Rate Compare?
Everyone who submitted a request for facilities under Prop 39 should have received a preliminary offer from their district by February 1 and, as a reminder, charters only have a few short weeks to respond (by March 1).
